DRUGS, POSSESSION CHARGES, SEARCH AND SEIZURE

If you have been arrested for a possession charge (possession of a controlled substance, possession of marijuana and/or possession of weapon).

I can help you. Most citizens who contact me about their possession case do not understand that in some instances their rights have been violated.

Let me answer some common questions people have about possession cases. . .

What rights does every citizen have?

The Fourth Amendment of the United States Constitution states that every citizen has the right to be free from illegal searches and seizures (searches or seizures without a warrant). If it is shown that the search and/or seizure of the contraband is illegal, the judge will dismiss your case.

The officer began to search my (car, home, and/or bag) without my permission, what can I do?

In most situations before the officer searches a car, a bag, or even pats a person down for weapons the officer must be able to state specific reasons why or the whole arrest and search is illegal. Most people do not know that in most situations the officer must receive consent from the person before beginning a search. Most defendants do not realize that they can refuse most searches that the officers conduct. The best thing that a person can do after being arrested after what they think is an unlawful arrest and/or search is to contact an attorney who has been successful in winning these cases. I have been successful in winning a number of these cases by showing the Courts that my clients were illegally stopped and searched.

My arrest was probably illegal, but I can't afford to fight, so I might as well take a plea.

NO! Most of the time people can not afford NOT to fight. After probation and possibly jail taking a cheap plea can end up costing over $5000.00 in fines alone. In some situations defendants can lose their jobs and/or be deported out of the country.

Texas is well-known for having some the harshest penalties for drug convictions. The severity of punishments often depend on the type of drug and how much of the drug is involved. Even a first offense for “simple possession” of a small amount of a drug can result in jail time, but a skilled defense lawyer can often convince the judge to recommend drug counseling instead.
